Utah Dependent with a Disability Exemption Reinstated

The Utah legislature has reinstated the Dependent with a Disability Exemption. This means you can claim an additional exemption on your Utah income taxes for dependents who have certain qualifying disabilities. This can help lower the amount of Utah income taxes you owe. The link below gives a full explanation, including the categories for eligibility. The main thing you should remember, however, is that you are required to complete a form TC-40D (link below) for each dependent that qualifies. The form requires that you get a signature from your school district or other agency, so don't wait till the last minute!

  1. Do you know what type of documentation may be required? For example, an IEP...my son's IEP is still being put together (halfway through the schol year!) and I don't know if I can claim this exemption if the IEP is not completed yet. Anyone know the answer to this? I feel tax dumb...

  2. This was a law some time ago and back then I just sent the form with my daughter and they signed it. I plan to do the same now that it has been reinstated.

    We never waited until the IEP was done because it can be well into the year by the time they have it (certainly seems to be what you are experiencing). In our case, there was an IEP from last year anyway that was usually within the same calendar year.
